Terms and conditions

These terms set out how you may use datanucleus.dev (our Website). Please read them before you use it. They include a section that limits our liability (section 12).

1Who we are

This Website is operated by Data Nucleus Ltd, a company registered in England and Wales under company number 15379792 (“Data Nucleus”, “we”, “us”, “our”).

You can contact us by email at client.support@datanucleus.co.uk.

2Accepting these terms

By using our Website, you confirm that you accept these terms and agree to comply with them. If you do not agree, you must not use our Website.

If you use our Website on behalf of an organisation, you accept these terms on its behalf.

3Other terms that may apply

Our privacy policy explains how we use the personal data you give us or that we collect when you use our Website. Our cookie policy explains the cookies we use. Our applicant data handling policy applies if you register your interest in a role or apply for one.

Our products and services, including free trials of Nucleus One, the Manufacturing Copilot pilot cohort, design partnerships, proofs of concept and consultancy, are provided under a separate written agreement. Where that agreement and these terms differ, the agreement applies.

4Changes to these terms

We may update these terms from time to time. Please check this page whenever you use our Website, because the version in force at that time applies to you.

5Changes to and availability of our Website

We may update or change our Website at any time, for example to reflect changes to our products, services or the needs of our clients.

Our Website is free to use. We do not guarantee that it, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict all or part of it for business or operational reasons.

6Information on our Website

The content on our Website is general information about Data Nucleus, our products and our services. It is not professional advice, and it is not an offer capable of acceptance. You should obtain professional or specialist advice before acting, or not acting, on it.

Figures, case studies and reference builds describe work we have done. The results any organisation achieves depend on its own data, systems and circumstances, so they are not a promise of the same result. The capabilities, deployment options and specification of any system we provide are those agreed in writing.

Articles in Insights reflect the position at the date shown and may not be updated. We make reasonable efforts to keep our Website accurate, but we do not guarantee that its content is accurate, complete or up to date.

7Intellectual property

We are the owner or the licensee of all intellectual property rights in our Website and its content, including text, graphics, product screens, animations, code and design. The Data Nucleus name and logo, and the names Nucleus One, Manufacturing Copilot and Agent Risk Passport, are ours. All rights are reserved.

You may view our Website, print or download extracts for your own reference or internal business use, and share links to its pages. You must not modify the material you print or download, use any illustration, animation or graphic separately from the text that accompanies it, or use any part of our content for commercial purposes without a licence from us. Our status as the authors of the content must always be acknowledged.

8Automated access and AI training

You must not use any robot, scraper, crawler or other automated means to copy or extract content from our Website, apart from search engine indexing. You must not use any content from our Website to train, fine-tune, evaluate or prompt an artificial intelligence or machine learning system, or for text and data mining, without our written permission. We reserve these rights to the extent the law allows.

9Information you send us

If you send us information through a form on our Website or by email, it must be accurate and you must be entitled to share it. We use it to respond to you, as our privacy policy describes.

Please do not send us confidential information, client data or personal data about other people through our forms or by email until we have agreed terms for handling it.

10Using our Website lawfully

You may use our Website only for lawful purposes. You must not:

  • use it in any way that breaches any applicable law or regulation, or that is fraudulent or harmful;
  • knowingly introduce viruses, malware or other material that is malicious or technologically harmful;
  • attempt to gain unauthorised access to our Website, the server on which it is stored, or any server, computer or database connected to it;
  • attack our Website through a denial-of-service attack or a distributed denial-of-service attack.

We will report any such breach to the relevant law enforcement authorities and cooperate with them, and your right to use our Website will end immediately.

11Links to and from our Website

Where our Website links to other sites and resources provided by third parties, the links are for your information only. We have no control over the content of those sites or resources and are not responsible for them.

You may link to any page of our Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not link in a way that suggests any form of association, approval or endorsement on our part where none exists, and you must not frame our Website on another site.

12Our responsibility for loss or damage

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

Our Website is provided free of charge for general information. To the extent the law allows, we exclude all conditions, warranties, representations or other terms that may apply to our Website or its content, whether express or implied.

If you use our Website as a business, we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with your use of, or inability to use, our Website, or your use of or reliance on any content on it. In particular, we will not be liable for loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, or any indirect or consequential loss or damage.

If you use our Website as a consumer, it is intended for business use, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity. Nothing in these terms affects your legal rights as a consumer.

We take reasonable steps to keep our Website secure, but we do not guarantee that it will be free from bugs or viruses. You are responsible for configuring your own technology to access our Website and should use your own virus protection software.

13General

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. If we do not insist that you meet any of your obligations under these terms, or delay in doing so, that does not mean we have waived our rights.

14Governing law and jurisdiction

These terms, their subject matter and their formation, and any dispute or claim arising out of or in connection with them, including non-contractual disputes or claims, are governed by the law of England and Wales.

If you are a business, the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of the country where you live.
